MAFC Victories in 2003

At the Michigan Public Service Commission (MPSC)
• In February the MPSC upheld the Code of Conduct rules prohibiting utility cross-subsidization in the HVAC industry.
• The MPSC found that Consumers Energy had violated the Code of Conduct in the first complaint case regarding the Code of Conduct. MAFC involvement was instrumental to its success. As a result the burden of proof will now be on Consumers in future complaints.
• In a subsequent complaint, MPSC staff has recommended the maximum allowable fine ($40,000) be assessed.

In the Courts - Judicial Victories
• The Michigan Supreme Court denied Consumers Energy request to intervene and override the Code of Conduct. |
In Lansing - Legislative Victories
•Only in the sense that we have been given a reprieve from the consequences of SB612 can the delay we achieved be considered a victory. Unless we take advantage of the extra time we have been granted and let legislators know how harmful unfair utility competition is then we will be right back here again next spring.
